THE FUNCTIONAL DIMENSION OF CONSENT IN THE CONSTITUTIONS OF EUROPEAN UNION COUNTRIES

Abstract

This article systematizes the functions of consent in the constitutions of European Union member states. Based on a formal legal and comparative legal analysis of constitutional norms, four key functions of consent are identified: legitimizing, coordinating, protective, and procedural. Each function is explained in detail, and various implementation models are demonstrated. It is established that the European model of functional differentiation of consent is distinguished by its detailed elaboration, encompassing both value-oriented and instrumental-procedural aspects. The results obtained can be used to improve constitutional procedures and in comparative constitutional studies.
