THE CURRENT STATE OF LEGISLATION ON ARTIFICIAL INTELLIGENCE IN THE RUSSIAN FEDERATION AND FOREIGN EXPERIENCE

Abstract

The article analyzes the current state of legislative regulation of artificial intelligence in the Russian Federation and foreign countries. The author concludes that, despite the high degree of doctrinal elaboration of the issue of the legal status of AI, the current Russian legislation does not contain a legal definition of AI and does not establish any elements of its legal personality. Regulation is based on the object approach with an emphasis on the activities of human operators. Foreign practice also does not recognize AI as a subject of law: the EU uses a risk-based approach (EU AI Act), China uses «point» regulation, the USA uses sectoral and soft regulation. The conclusion is made about the need for comprehensive regulatory consolidation of the legal status of AI.
