PROSECUTOR’S SUPERVISION AND PROTECTION OF HUMAN RIGHTS: THE ROLE OF THE PROSECUTOR IN ENSURING ACCESS TO JUSTICE
Abstract
The article examines the role of the prosecutor’s office in the system of protecting human and civil rights and freedoms, as well as the significance of prosecutor’s supervision as a universal mechanism for ensuring access to justice. The constitutional and legal foundations of the prosecutor’s office activities, as well as the forms of the prosecutor’s participation in criminal, civil, administrative and constitutional proceedings, are analyzed. Special attention is devoted to the prosecutor’s supervisory powers at the pre-trial stages of criminal procedure, participation in court hearings, and interaction with other human rights institutions, in particular with the Commissioner for Human Rights. The conclusion substantiates the systemic nature of the human rights function of the prosecutor’s office, which ensures the genuine restoration of violated rights.
