PROBLEMS OF LEGAL REGULATION OF THE CARRIAGE CONTRACT IN THE CIVIL LAW OF THE RUSSIAN FEDERATION
Abstract
This scientific article focuses on the most pressing issues related to the legal framework for cargo transportation contracts, drawing on the current laws of the Russian Federation. The study addresses controversial aspects directly related to the specific nature of the transportation contract, such as its classification as an agreement between the parties or a transaction that requires actual delivery, as well as the need to determine the cost as a mandatory element of the agreement. Additionally, the article delves into the distinction between the terms "transportation" and "carriage" from a civil law perspective. The article analyzes judicial practice, identifies contradictions in law enforcement, and suggests ways to improve the legislation governing cargo transportation contracts.
