PROBLEMS OF TORTURE QUALIFICATION

Abstract

The article examines the current problems of the criminal qualification of torture under Article 117 of the Criminal Code of the Russian Federation, including the differentiation of this composition from related acts. The author analyzes the difficulties of proving the physical and mental suffering of the victim, as well as the uncertainty of legislative criteria for systematic actions. Special attention is paid to the need for the participation of specialists in the field of psychology in establishing the fact of causing moral torment. Based on the identified gaps, proposals are formulated to improve legislation and unify judicial practice to ensure effective protection of individual rights.
