Abstract

The article examines the problematic aspects of the qualification of the privileged composition of the murder provided for in Article 107 of the Criminal Code of the Russian Federation. The correlation between the concepts of "affect" and "strong emotional excitement" is analyzed, the objective and subjective signs of a crime are considered. Special attention is paid to the role of forensic psychiatric examination and the problems of law enforcement practice. The authors conclude that it is necessary to improve legislative terminology.
