PROBLEMS OF QUALIFICATION OF DELIBERATE CAUSATION OF SERIOUS HARM TO HEALTH, RESULTING IN THE ACCIDENTAL DEATH OF THE VICTIM

Abstract

The article examines the criminal law analysis of an act that poses a high public danger, namely, the intentional infliction of serious bodily harm that resulted in the victim's death due to negligence. The key aspects of this issue are presented. Despite the apparent simplicity of the legal structure of this offense, there are significant challenges in its proper legal assessment and subsequent prosecution. The article addresses several controversial aspects in the qualification of this act and the imposition of punishment under Part 4 of Article 111 of the Criminal Code of the Russian Federation (hereinafter referred to as the Criminal Code).
