Abstract

This article is devoted to the analysis of the transformation of prosecutorial supervision over operational-search activities (OSA) in the context of the rapid development of digital technologies. The key challenges associated with the use of Big Data, artificial intelligence, facial recognition technologies and other digital tools during operational-search measures (OSMs) are examined. These challenges generate new risks of violation of citizens’ constitutional rights and problems of ensuring information secrecy. Particular attention is paid to the difficulties of proving in court the legality of obtaining and the reliability of digital operational-search data, as well as issues of protecting confidential information from unauthorized access. The article concludes that it is necessary to adapt legislation, improve the qualifications of prosecutors and strengthen interdepartmental cooperation to ensure effective supervision and human rights protection in the context of digital transformation.
