SOME PROBLEMS OF THE PUBLIC PROSECUTOR'S REFUSAL TO BRING A CASE IN COURT

Abstract

The article highlights certain problems associated with the public prosecutor's refusal to prosecute in court. During the research, the authors identify legislative gaps that significantly hinder the implementation of this institution. Attention is drawn to the procedural aspect of the issue, as the law does not specify requirements for the form of the prosecutor's refusal to prosecute, nor does it provide provisions regarding the form of the change in the prosecution. The authors emphasize the role of the court in the prosecutor's refusal to prosecute and the influence of the victim's side in this matter. It is concluded that due to the existence of significant gaps, the practice of implementing this institution is relatively limited.
