Abstract

Article 256 of the Criminal Code of the Russian Federation, which establishes liability for the illegal extraction of aquatic biological resources, is one of the most widely used norms in the field of environmental law. This study focuses on a comprehensive analysis of the elements of this crime. The author provides a detailed description of the objective and subjective aspects of the offense. The study analyzes current court cases and identifies and systematizes common issues in the qualification of crimes. Based on the findings, the study proposes recommendations for improving law enforcement and criminal legislation in this area.
