PROBLEMS OF QUALIFICATION OF CRIMES RELATED TO DRIVING TO SUICIDE, INDUCING SUICIDE OR ASSISTING IN ITS COMMISSION

Abstract

The article analyzes the problems of qualification of crimes related to suicide, suicidal tendencies or assistance in its commission. In order to distinguish between the considered types of crimes, a comparative legal analysis of the signs of both objective and subjective sides was carried out, as a result of which it was concluded that persuasion, persuasion and assistance are independent forms of suicidal motivation of the victim, differing in the degree of public danger, the greatest of which is bringing, and the least - assistance, and signs of the objective side.
